Le droit est traditionnellement lié à la pratique du commandement et de la hiérarchie. Il semble qu’une règle juridique établisse une immédiate relation entre une norme supérieure et une norme inférieure. La conception hiérarchique et impérative peut néanmoins être remise en cause dès lors que la phénoménologie de la règle juridique est appréhendée d’un point de vue interne, celui de ceux que l’on peut considérer comme les « utilisateurs » de la règle plutôt que ceux qui la subissent. Une approche (...) tournée vers la pratique pourrait, de cette façon, conduire à une théorie du droit plus ouverte et, d’une certaine façon, moins idéologique ou sectaire. C’est – comme le défend cet article – le programme ou mieux la promesse que l’on trouve dans l’ouvrage principal de Hart, le Concept de droit. Cet article tente de rendre cette promesse plus transparente sans toutefois dissimuler les difficultés de sa stratégie narrative et argumentative. (shrink)

Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...) a more liberal, and also somehow less parochial and ideological, road for legal theory. This is – it is argued in the paper – the programme, or better, the promise we can find in Herbert Hart’s main work, The Concept of Law. The article tries to render this promise more transparent while, nonetheless, not eschewing the blind sides of its narrative and argumentative strategy. (shrink)

A reflection on the philosophical traditions at the Autonomous University of Nuevo Leon and in the city of Monterrey.

Many of the social deprivations of Mexico will be worsened due to the SARSCOV2 pandemic. Namely, the insufficient access to public health, lack of labor rights, and the unsuccessful government’s response to eradicate male violence against women. The historical unconcern in promoting a culture rooted in mutual aid and self-care has provoked many citizens are disconnected from their social and health rights. Thus, people’s inability to carry through one direction –stay home- is unfulfilled, in part, due to structural inequalities. I (...) affirm that effective liberty could be obtained by approving a Universal Basic Income from a feminist perspective. I conclude that the aftermath of COVID-19, which will define everyday life for a while, require the endorsement of such measure. Likewise, women as a class deserve protection from a feminist critical framework. (shrink)

In this chapter I will present, in a general way, Millikan's biosemantic theory of the phenomenon of intentionality. For this purpose, the text will take the following path. First, I will present the problem of intentionality and an overview of the dominant theories of intentional content during the twentieth century and part of the twenty-first century. Then, I will present a general version of Millikan's biosemantic theory, appearing in 1984, which will allow us to see what the relevance and originality (...) of his proposal consists in. Finally, in keeping with one of the central purposes of Las filósofas que nos formaron, I will share a brief interview that Millikan very kindly agreed to give for this publication, in which she tells us some non-theoretical aspects of her history as a philosopher. In Philosophy, it is well known that of the total faculty population, the proportion of women is significantly lower than men. This disproportion is odd for a discipline within the humanities; these numbers seem more compatible with what is found in STEM (Science, Technology, Engineering, Mathematics) careers. These proportions are in turn a product of the low female presence that exists from the previous levels of academic training in philosophy. What happens in the case of the philosophy student body? For (...) example, the report presented by BeeBee and Saul (2011), on women in philosophy in the United Kingdom, in the period 2008 and 2009, points out that in the first degrees of academic training, in the bachelor's degree, women occupy 45% of the student population, in the master's degree 38% and in the doctorate 35%. Thus, "it is notable that there is a reduction in the proportion of women from the bachelor's degree to the doctorate [...]. This has as a consequence that at the professional level women holding positions as professors represent only 19%" (BeeBee & Saul, 2011, p. 11). Recently, Torres González (2018), based on European Union studies, points out that in Spain, with respect to gender disparity in students, "the data yield as a result masculinized studies, where, contrary to what happens in the branch of the humanities to which it [philosophy] belongs, males outnumber females by 28 percentage points" (2018, p. 328). This disparity is reflected in philosophy at the professional level, "the indicators of vertical segregation show a reinforced glass ceiling, which presents one of the worst data of hierarchical discrimination in the university: the percentage of female professors in philosophy is 12% compared to 21% of female professors in higher education" (Idem). Although it is a fact that there are fewer women than men studying philosophy and, therefore, fewer women than men working professionally in this discipline, we do not yet have possible explanations for this phenomenon of gender disparity in the student body in philosophy. In some cases, even if the number of women entering the philosophy degree program is already low, the number of women graduating is even lower, which indicates that there is attrition along the way; the initial numbers of women entering the program tend to decrease by the time they graduate. Thus we come to the question that is the subject of this paper: What causes female students to drop out of the philosophy program? In this article we answer this question from the philosophy of science and supported by local empirical data, so we do not give a complete or even less exhaustive answer. We review two explanatory models that purport to answer the question of why there are fewer women in philosophy, both formatively and professionally. These are the Different Voices Model (DVM) and the Perfect Storm Model (PSM); we opt for the latter and give reasons for it. Regarding the empirical aspect of our research, our source of statistical data belongs to the undergraduate program in philosophy at the Facultad de Estudios Superiores Acatlán-UNAM, Mexico (FES Acatlán), obtained in the framework of the SWIP-Analytic Mexico workshops. Our analysis of these data shows that even when female students have better GPAs than male students and take fewer subjects while enrolled, female students graduate less than male students in the FES Acatlan degree program. Can a person from Latin America be a Catholic, or a feminist, or a democratic socialist in an authentic way? These identities come from Europe, and given the colonial history of Latin America, it seems reasonable to think that decolonizing the Latin American mind is a condition for its authenticity. Further, it seems reasonable to think that decolonization itself requires extirpating ideas and identities originating from the colonizers, especially those used to establish the colonial order. Thus, it seems that Latin (...) Americans cannot adopt such identities; authentic decolonization demands otherwise. In this paper I argue that the thought of twentieth century Mexican philosopher Jorge Portilla provides a persuasive account of the nature of authentic self-creation that allows for a kind of decolonization that makes it conceptually possible for Latin Americans to be Catholics, feminists, or democratic socialists in an authentic fashion. That is, authentic decolonization of the mind, I argue, need not involve a blanket rejection of identities originating from the colonizers; instead, it can be understood as a particular kind of authentic self-creation: one that is appropriately sensitive to the colonial history of the identities freely chosen by the agent. Spinoza’s philosophy could be understood as a tireless research of the truth. Nevertheless it can’t be interpreted as a path that leads only the wise to the salvation. The effort to reach the bliss, freedom, the true knowledge of the mind, has to belong to all humanity. So the role of the philosopher must be to encourage men to seek the truth, to love it through the union with God above all else. This is the soteriological fabric of the early (...) works of Spinoza. It will lead to the exaltation of the homo liber and of the Spirit of Christ as the way of salvation in his mature works. Nature’s knowledge will be the lifeblood in the context of the research for the universal salvation of individuals as a happy community. (shrink)

La libertà di pensiero è l'assunto principale della filosofia di Spinoza in età moderna. La posizione dei filosofi nei confronti dell'ortodossia religiosa è particolarmente delicata, dal momento che pone in questione l'autorità stessa delle Scritture e la verità della Torah e della Chiesa. In particolare Spinoza riflette nel Trattato Teologico Politico del nesso tra il libero pensiero e l'obbedienza del popolo Ebraico alla Legge Mosaica.

El objetivo de este artı́culo es desarrollar un enfoque para la comprensión de las crisis sociales basado en la “tragedia de los comunes” (TDC), centrada principalmente en sus interpretaciones en la teorı́a de juegos. Al analizar las principales interpretaciones de la TDC, lo que se observa, en primer lugar, es una caracterización del ambiente idóneo para la crisis sociales y, en segundo lugar, la existencia de una lógica con los siguientes elementos: (1) Las decisiones de individuos en contextos de interacción (...) social; (2) La existencia de mecanismos polı́ticos; (3) La existencia de mecanismos sociales. Con estos elementos a la vista lo que sostengo es que contra la idea general de la TDC, los comunes pueden llevar a cabo medidas para enfrenar la crisis por sı́ mismo (en este caso el factor relevante para resolver el problema es la cooperación). Sin embargo esto se encuentra supeditado a factores que exceden a los modelos aquı́ considerados. Además, dada la naturaleza del problema, una idea que se deriva del análisis desarrollado en este artı́culo es que no siempre basta con establecer acuerdos cooperativos para resolver una crisis, ni que todo acuerdo siempre es la mejor opción. Il lavoro di tesi analizza il problema cristologico nella filosofia di Spinoza alla luce delle riletture contemporanee sul tema, attraversando questioni di argomento etico, pedagogico e religioso. Viene condotto dall'autore un meticoloso lavoro di analisi relativo alle occorrenze testuali delle espressioni riferite a Cristo e ai Cristiani nell'intera produzione spinoziana. Sebbene il tema cristologico non sia affrontato quasi mai in modo esplicito dal filosofo olandese, il lavoro di tesi mostra quanto diffusi siano tali riferimenti e come possa essere interessante rileggere (...) Spinoza proprio a partire dalla sua profonda ammirazione nei confronti della figura più affascinante della storia dell'Occidente. (shrink)

Jürgen Habermas ha dedicato più di trent’anni dei suoi studi alle scienze sociali al fine di definire, attraverso la ricostruzione delle tradizioni di pensiero in esse presenti, un quadro teorico di riferimento che orienti i programmi della ricerca storico-sociale. Al pari dei grandi classici del pensiero sociologico, egli ha cercato di affrontare i “problemi della società nel suo insieme” esplicitando gli assunti, i metodi e gli obiettivi della teoria sociale come presupposto indispensabile per un’indagine che ampli i confini disciplinari della (...) sociologia, da un lato, alla riflessione filosofica, dall’altro alla ricerca storiografica. Nel lungo itinerario della sua formazione scientifica questo programma rappresenta il filo conduttore nell’analisi dei “sistemi culturali”, dei “sistemi sociali”, dei “sistemi della personalità” e, soprattutto, nella “teoria dell’evoluzione sociale”, dalla ricostruzione delle condizioni necessarie alla genesi antropologica delle forme socio-culturali di vita – l’“ominizzazione” – sino all’esame della logica e della dinamica di sviluppo delle “formazioni sociali” che egli suddivide in primitive, tradizionali, moderne e contemporanee. Nella Postfazione all’edizione italiana di Profili politico-filosofici (2000), una raccolta che contiene scritti di quarantacinque anni di studi (1953-1998), Leonardo Ceppa sottolinea i due aspetti essenziali dell’opera di Habermas: “la coerenza teorica” e il “carattere assimilatorio”. Habermas non è un pensatore “rivoluzionario” ma un “riformista” che, ricorrendo a un’immagine ingegneristica, all’isolamento del “pensiero che scava fossati” preferisce “costruire ponti” tra i campi del sapere. Questa ricerca si segnala per il tentativo di recepire criticamente le acquisizioni specialistiche delle scienze sociali e della filosofia finalizzando questa tensione apprenditiva alla costruzione di un quadro generale. Nato dai nostri colloqui seminariali, di cui mantiene la forma dialogica dei “turni di parola”, il presente volume focalizza lo sguardo sulle società contemporanee – ripercorrendone la struttura, le sfide presenti e gli scenari futuri – e sulla funzione sociale della sociologia. Ne scaturisce un’indagine di fenomeni fondamentali per comprendere le trasformazioni della modernità: la modernizzazione, il capitalismo organizzato, lo stato sociale, la democrazia politica, la diversità culturale, l’opinione pubblica nell’epoca dei media, la globalizzazione, la crisi ecologica, le disuguaglianze mondiali, i conflitti nazionalistici, il terrorismo islamico, la secolarizzazione, l’ingegneria genetica, l’integrazione europea e la politica mondiale. Nel riordinare i temi sociologici da lui proposti abbiamo cercato di sistemare l’analisi delle società contemporanee a un livello che non si accomodi sul piano dei commenti troppo facili che gli intellettuali, i politici e la gente comune amano fare sull’attualità e che, mantenendo una visione d’insieme sull’opera, chiarisca il testo e i suoi punti ciechi. Il volume si propone come uno strumento di lavoro che accompagni a una lettura critica. Sullo sfondo rimane la domanda se Habermas riesca davvero a conseguire, nei suoi itinerari attraverso la “storia delle idee”, la coerenza logica e la profondità d’indagine necessarie a “sistematizzare” le ricerche delle scienze sociali. Alcune perplessità avvalorate dal confronto con i testi e con la letteratura critica ci hanno suggerito di riservare ai problemi metodologici uno studio specifico che chiarisca il concetto di “scienza ricostruttiva” e ne illustri le applicazioni nell’ambito delle teorie della riproduzione culturale, della socializzazione e dell’evoluzione delle formazioni sociali – uno studio le cui linee sono solo anticipate nell’Introduzione. Il programma di ricerca e la sua recezione critica, relativamente agli assunti della teoria dell’evoluzione sociale. Riprendendo una felice espressione di Karl Popper, ci auguriamo di aver raggiunto la chiarezza argomentativa e la semplicità linguistica dovuta al lettore, confidando nella “cooperazione amichevole-ostile di molti scienziati”. Il lavoro concerne il delicato tema della libertà umana nella prospettiva spinoziana. L'obbedienza e la saggezza sembrano costituire le due possibilità per l'uomo dinanzi al raggiungimento della salvezza. Il filosofo olandese delinea nelle sue opere, e in particolare nel Trattato Teologico Politico, due percorsi in grado di condurre gli uomini verso la beatitudine. La dicotomia tra i due percorsi - il primo segnato da una conoscenza chiara e intuitiva del sommo bene, il secondo da un'azione morale ispirata alla carità - (...) viene risolta analizzando il messaggio cristiano, che costituisce uno dei principali punti di discussione tra Spinoza e le sette ereticale del suo tempo. Si se identifica libertad con voluntad, se corre el riesgo de tomar a la primera como el único aspecto en que la voluntad se desenvuelve, es decir, considerar el querer como mera actualización de la libertad. Pero la libertad no es más que un aspecto parcial de la voluntad, un aspecto cualitativo del querer, pues el dinamismo de la voluntad procede de su naturaleza y no del hecho de la libertad del acto del querer. La relación entre la inteligencia y (...) la voluntad es lo que caracteriza al acto específicamente humano. Por ello, se impone el análisis de la reciprocidad de influencia de las dos facultades espirituales en su propia unidad viva y funcional, pues si bien el libre albedrío se identifica con el momento de la elección, la libertad recorre todo el acto humano. Puesto que la voluntad tiende naturalmente a lo que supone perfeccionamiento del hombre, la libertad debe fomentar en el caso concreto esa orientación natural de la voluntad, es decir, elevarla a la práctica en la realidad concreta. Que la libertad disponga de la posibilidad de obrar en contra o al margen de ella, es decir, de romper de alguna forma la orientación natural de la voluntad, violentándola y torciéndola, es un defecto y también una forma de esclavitud, pues el hombre cuando obra el mal peca actúa al margen de la razón, conduciéndose como si fuese movido por otro distinto de él mismo. La posibilidad de apartarse del bien no pertenece a la esencia y a la perfección de la libertad, pues ésta consiste en obrar según la razón, impulso propio de acuerdo con su naturaleza. Los dos planos o motivaciones determinantes en que se articula la voluntad, como son el querer natural y necesario y, además, el querer deliberado y libre, son imprescindibles para dar un enfoque correcto al problema de la libertad: pues lo importante es apreciar en la acción libre la parte que se debe a la naturaleza de la voluntad, dándose la libertad únicamente como posibilidad de poner por obra un acto volitivo de acuerdo o no con la orientación natural de aquélla. El interés de esta indagación se centra especialmente en la voluntad deliberada o amor electivo del Bien. Podrá comprobarse la armonía constitutiva que reina entre la intención del fin y la elección de los medios, tema central cuando se estudia la psicología y la filosofía moral de Santo Tomás de Aquino. Las siguientes páginas se deciden a favor de la distinción entre intención del fin -intentio finis- y elección de los medios -electio mediorum-, haciendo partícipe a la voluntad deliberada del último fin en concreto, es decir, de Dios, a través de la intención, salvando así el poder de autodeterminación de la voluntad hacia el fin último en concreto, con lo que se abren las puertas a la conducta moral del hombre. Santo Tomás enfoca el problema de la libertad sin excluir ninguno de los tres planos en los que se articula, como son el plano ontológico, el plano psicológico y el plano moral, ya que el hombre tiene el deber de realizar en cada momento el máximo de su libertad en orden al perfeccionamiento de su ser, en una costosa labor de autocreación y no de caprichosa elección. Así, pues, el mayor ejercicio de libertad humana está en decidirse por su último fin en concreto, es decir, por Dios, a través de una adecuada elección de medios y de una recta intención, pues el hombre, en tanto que criatura, procede de Dios, y en tanto que hombre, tiene su fin último en la glorificación de Dios, en un doble ritmo de procesión y de retorno, poniéndose así de manifiesto el carácter religioso de la moral. Es por ello que el problema de la libertad es, en último término, un problema metafísico, que consiste en el movimiento natural y deliberado de la persona humana hacia su plenitud. (shrink)

Con una metodología analítico-sintética, el propósito del presente artículo es ofrecer un fundamento teórico sobre la legitimidad de los actos y las decisiones morales. Por consiguiente, se resolverá la siguiente cuestión: ¿cuál es la función ética del derecho, en el marco del ejercicio de una conciencia y consciencia construidas por agentes morales? Se concluye que la coacción legítima debe fundarse en la protección universal de toda persona y en el sometimiento a objeciones por parte de los ciudadanos, con el propósito (...) de revisar la legitimidad y legalidad de las normas jurídicas. Questo volume raccoglie interventi che esplorano la sua opera mostrandone la fertilità e sottolineando al tempo stesso la prossimità delle sue idee con le principali sfide del nostro tempo. Dall’Italia al Brasile, passando per gli Stati Uniti, l’Irlanda, la Francia, il Belgio, il Messico e la Cina, gli autori si soffermano su temi che comprendono l’estetica, la politica, la teoria della comunicazione, i (...) queer studies, il pensiero rituale e religioso, la sessualità e la letteratura, restituendo la plurivocità e l’originalità di un filosofo di respiro internazionale e più che mai attuale. La réflexion sur l’éthique et la participation des jeunes et des enfants à l’aménagement com- porte au moins deux dimensions : d’une part, les justifications d’une telle participation ; d’autre part, les problèmes que la pratique participative fait émerger et face auxquels les cadres de réfé- rence conventionnels (non participatifs) ne sont pas toujours utiles. Le présent article aborde ces deux dimensions et explore leurs liens à la lumière de trois méthodes distinctes en matière de théorie morale, soit l’éthique déontologique, (...) l’éthique conséquentialiste et l’éthique de la vertu. Sur la base d’une expérience participative d’aménagement inscrite dans le programme Grandir en Ville de l’UNESCO, certaines contradictions entre les principes d’une pratique participative avec des enfants et la manière dont les problèmes éthiques sont parfois gérés sont mises en évidence. En urbanisme, l’approche phénoménologique permet de se pencher sur l’expérience de l’individu et, plus précisément, sur le rapport que celui-ci entretient avec son milieu de vie. Cette approche permet de concevoir des milieux de vie mieux adaptés aux besoins et aux expectatives des individus et suppose des démarches d’aménagement qui accordent un rôle important au citoyen. Toutefois, si l’approche phénoménologique est couramment utilisée dans le cadre de travaux théoriques, elle est difficilement adoptée sur le terrain, en dépit de son utilité (...) et des justifications que l’on peut donner à son utilisation au plan éthique. Dans le présent article, nous explorons les raisons d’une telle disparité en levant le voile sur une double difficulté : difficulté professionnelle, d’une part, à dépasser le modèle déterministe du rapport personne–environnement ; diffi- culté scientifique, d’autre part, à ancrer la production de connaissances dans les processus de transformation du milieu de vie. Understanding the ethical concerns of paid and altruistic surrogacy requires a knowledge of reproductive freedom and procreative autonomy. An accurate approach must be sensitive enough of the nature of sexual oppression, specifically in its influence in women’s choices, self-identity and personal relationships. The aim of this essay is to stand up for the prominence of radical feminism in questioning reproductive liberalism, which overfocus the interests of the so-called intended parents. Having in mind what egalitarian philosophers have put forward from a (...) social-relational autonomy view to allow surrogacy contracts under certain circumstances —particularly, they suggest that legalization could be compatible with women’s reproductive autonomy following an altruistic fashion under protective measures and supportive to the surrogate’s revocation of consent—, I uphold that radical feminists properly make clear how oppression remains in the cultural environment that endorses surrogacy contracts. A macroscopic methodology, based on American philosopher’s Marilyn Frye metaphor of the caged bird, is a helpful tool to comprehend why surrogacy contracts do not enhance women’s reproductive autonomy, even if they enable some surrogate mothers to gain an income enough to endure tough economic pressure. El desarrollo del pensamiento crítico en la educación superior se inscribe en un contexto de transición de paradigmas. El paso de la modernidad a la postmodernidad y lo que esto significa en términos de modificación de parámetros de comprensión, de transformaciones en los ámbitos político, económico, social y cultural genera cambios en el sujeto. Desde experiencia docente se hace evidente la ausencia de pensamiento crítico en los estudiantes de los primeros niveles de educación superior, y por ello, la necesidad de (...) implementaciones didácticas innovadoras en el proceso de enseñanza. El presente documento tiene como objetivo presentar los aportes de la didáctica al desarrollo del pensamiento crítico en estudiantes de educación superior. Se trata de una revisión de tipo exploratoria-descriptiva; de carácter bibliográfico y con enfoque cualitativo. Se concluye que, la didáctica permite a los docentes orientar de manera consciente y creativa el proceso de enseñanza aprendizaje, ya que, al ser selectivos en los distintos métodos y técnicas aplicados en el proceso educativo contribuyen para potenciar el desarrollo del pensamiento crítico y para el desarrollo de capacidades cognoscitivas, sociales y afectivas integradoras de análisis, puntos de vista, problemas, decisiones y posturas que permiten en mejor desenvolvimiento del sujeto en el contexto. Las corrientes intelectuales e ideológicas posthumanistas abogan por la superación de diferentes límites biológicos de la especie humana. La ruptura incluye los asuntos reproductivos, como estrategias para la supervivencia y como cuidado de una dignidad posthumana. En este trabajo, quiero esbozar cuestiones del trans y posthumanismo reproductivo interesado en la gestación subrogada (GS) en sus diferentes modalidades. La GS es relevante para reconducir la reproducción siguiendo criterios promotores de la elección individual. Comienzo subrayando la herencia liberal en el movimiento por (...) la mejora humana y la elección procreativa. Después, sugiero que el posthumanismo reproductivo se apoya en los estudios de género y en la permisividad del comercio sexual para redefinir la GS como probable reproducción posthumana. Así, los objetivos del posthumanismo reproductivo ambicionan una agenda distinta a la feminista. Las perspectivas posthumanas y feministas proponen horizontes de justicia reproductiva que deberán criticarse en contexto antes de que los estados-nación procedan con reformas. (shrink)

La tesis aborda uno de los temas centrales en la filosofía de la mente y las ciencias cognitivas: los conceptos como unidades básicas de la cognición humana. La tesis central que se defiende es que el contenido de los conceptos es determinado parcialmente por las comunidades a las que pertenecen los sujetos cognitivos, en la medida en la que dichas comunidades guían y constriñen las interacciones entre el sistema cognitivo conceptual y el entorno del que forma conceptos. La novedad de (...) la tesis es doble. Por una parte, cuestiona las teorías dominantes sobre el contenido de los conceptos —las teorías descriptivistas y las teorías naturalistas—, no solamente a partir de desafíos filosóficos que muestran sus limitaciones, sino también a partir de evidencia empírica sobre el efecto de las interacciones sociales en el contenido de los conceptos y, por tanto, en la cognición. Por otra parte, proporciona evidencia empírica sobre infantes ferales (i.e. niños salvajes), cuyo sistema cognitivo conceptual no ha recibido la guía de ninguna comunidad humana en sus interacciones con el entorno. Dicha evidencia permite sugerir que una explicación puramente naturalizada del contenido, sin la presencia de las comunidades, no puede explicar el desarrollo cognitivo conceptual de dichos infantes. Así, la tesis logra proponer un papel no trivial de las comunidades en el debate sobre la determinación del contenido semántico de los conceptos. (shrink)

En economía, la investigación se divide en dos grandes metodologías: los modelos teórico-matemáticos y los estudios empíricos. Estudiando modelos teóricos y métodos empíricos ) se da cuenta de las limitaciones de ambos métodos. Se concluye que ninguno de estos puede generar explicaciones de cómo en realidad suceden las cosas, sino que solo de cómo posiblemente suceden. La razón es que ambos necesitan un enlace interpretativo que permita extrapolar desde su propio sistema hacia un sistema objetivo. Los modelos tienen dominio general (...) y pueden dar cuenta de mecanismos. Los RCTs, al contrario, son válidos internamente y están conectados al mundo real, pero su dominio es muy específico. Aunque ninguno logre responder preguntas amplias de un fenómeno de interés, pueden complementarse para generar extrapolaciones más confiables sobre un sistema objetivo. Sin embargo, esto solo podrá hacerse si se conocen bien los mecanismos y el contexto en que ocurre una evidencia. En la generación de daños ambientales los derechos individuales y colectivos pueden verse vulnerados, cuando se trata de comunidades indígenas, tribales y afrocolombianas, por la forma en la que estas conciben la naturaleza y la íntima relación que existe entre el ambiente y sus planes de vida. Por lo tanto, ante la presencia de daños en el ambiente de estas comunidades puede generarse de forma desencadenante un daño cultural, porque estas poblaciones son las que pierden el escenario raigal y ancestral (...) en el que desarrollan sus prácticas de identidad cultural. Precisamente, en el presente texto se pretende discernir si ante la presencia de un conflicto ambiental en el Arroyo de San Basilio de Palenque, que a su vez es centro de las relaciones socioeconómicas, culturales y lúdicas de los miembros de esta comunidad, se logra desencadenar un daño cultural. Reconstruying historically the beginning of development scientific thought in Venezuela, particularly in Physics, allow to account imperative need to preserve academic-scientific formation of Venezuelan society in 21st century. The Venezuelan historians Rafael Balza and Yajaira Freites in their respectively studies "Modern Physics in the Caraqueña Society of the late eighteenth century: between Mathematics and technique and "The problem of knowledge between hacendados and illustrated merchants of the province of Caracas-Venezuela (1793-1810)" allow to account efforts of Agustín de la Torre (...) to insert, in Venezuelan society of 18th century, teaching , research, divulgation and application of modern physical sciences initiated in Europe, marking the beginning of development of eighteenth-century Venezuelan technical and scientific thought. It should be noted that historical study of Agustín de la Torre is a complicated due to scarce documentation and cultural complexity of eighteenth-century Venezuela. The contribution of study is to account for risk of loss of Science in Venezuela in XXI century, through historical reconstruction around of Agustín de la Torre and his countless and tireless efforts to develop the study and application of physics experimental in Venezuela. The scope of this research is framed in the need to show the importance in the preservation of scientific talent. Studying the efforts in eighteenth-century Venezuela allows this. The historical study around Agustín de la Torre gives an account of the origin in the studies of physics and the complex situation within the scientific and social context to develop Science in Venezuela. ‘‘Theoretical biology’’ is a surprisingly heter- ogeneous field, partly because it encompasses ‘‘doing the- ory’’ across disciplines as diverse as molecular biology, systematics, ecology, and evolutionary biology. Moreover, it is done in a stunning variety of different ways, using anything from formal analytical models to computer sim- ulations, from graphic representations to verbal arguments. In this essay I survey a number of aspects of what it means to do theoretical biology, and how they compare with the allegedly much more restricted (...) sense of theory in the physical sciences. I also tackle a recent trend toward the presentation of all-encompassing theories in the biological sciences, from general theories of ecology to a recent attempt to provide a conceptual framework for the entire set of biological disciplines. Finally, I discuss the roles played by philosophers of science in criticizing and shap- ing biological theorizing. (shrink)

De se attitudes seem to play a special role in action and cognition. This raises a challenge to the traditional way in which mental attitudes have been understood. In this chapter, we review the case for thinking that de se attitudes require special theoretical treatment and discuss various ways in which the traditional theory can be modified to accommodate de se attitudes.

A commonly held idea regarding the nature of time is that the future is open and the past is fixed or closed. This article investigates the notion that there is an asymmetry in openness between the past and the future. The following questions are considered: How exactly is this asymmetry in openness to be understood? What is the relation between an open future and various ontological views about the future? Is an open future a branching future? What is the relation (...) between an open future and the question of whether contingent statements about the future are true or false? Is an open future compatible with a single determinate future? (shrink)

Genes are often described by biologists using metaphors derived from computa- tional science: they are thought of as carriers of information, as being the equivalent of ‘‘blueprints’’ for the construction of organisms. Likewise, cells are often characterized as ‘‘factories’’ and organisms themselves become analogous to machines. Accordingly, when the human genome project was initially announced, the promise was that we would soon know how a human being is made, just as we know how to make airplanes and buildings. Impor- tantly, (...) modern proponents of Intelligent Design, the latest version of creationism, have exploited biologists’ use of the language of information and blueprints to make their spurious case, based on pseudoscientific concepts such as ‘‘irreducible complexity’’ and on flawed analogies between living cells and mechanical factories. However, the living organ- ism = machine analogy was criticized already by David Hume in his Dialogues Concerning Natural Religion. In line with Hume’s criticism, over the past several years a more nuanced and accurate understanding of what genes are and how they operate has emerged, ironically in part from the work of computational scientists who take biology, and in particular developmental biology, more seriously than some biologists seem to do. In this article we connect Hume’s original criticism of the living organism = machine analogy with the modern ID movement, and illustrate how the use of misleading and outdated metaphors in science can play into the hands of pseudoscientists. Thus, we argue that dropping the blueprint and similar metaphors will improve both the science of biology and its understanding by the general public. (shrink)

In this paper I consider two strategies for providing tenseless truth-conditions for tensed sentences: the token-reflexive theory and the date theory. Both theories have faced a number of objections by prominent A-theorists such as Quentin Smith and William Lane Craig. Traditionally, these two theories have been viewed as rival methods for providing truth-conditions for tensed sentences. I argue that the debate over whether the token-reflexive theory or the date theory is true has arisen from a failure to distinguish between conditions (...) for the truth of tensed tokens and conditions for the truth of propositions expressed by tensed tokens. I demonstrate that there is a true formulation of the token-reflexive theory that provides necessary and sufficient conditions for the truth of tensed tokens, and there is a true formulation of the date theory that provides necessary and sufficient conditions for the truth of propositions expressed by tensed tokens. I argue that once the views are properly formulated, the A-theorist’s objections fail to make their mark. However, I conclude by claiming that even though there is a true formulation of the token-reflexive theory and a true formulation of the date theory, the New B-theory nonetheless fails to provide a complete account of the truth and falsity of tensed sentences. There is currently disagreement about whether the phenomenon of first-person, or de se, thought motivates a move towards special kinds of contents. Some take the conclusion that traditional propositions are unable to serve as the content of de se belief to be old news, successfully argued for in a number of influential works several decades ago.1 Recently, some philosophers have challenged the view that there exist uniquely de se contents, claiming that most of the philosophical community has been under the (...) grip of an attractive but unmotivated myth.2 At the very least, this latter group has brought into question the arguments in favor of positing special kinds of content for de se belief; I think they have successfully shown that these arguments are not as conclusive, or fully articulated, as many have taken them to be. In this paper I will address these challenges directly and I will present and defend an argument for the conclusion that the phenomenon of de se thought does indeed motivate the move to a special kind of content, content that is uniquely de se. First, I characterize a notion of de se belief that is neutral with respect to friends and foes of uniquely de se content. I then argue for a determination thesis relating de se belief to belief content: that there is no difference in de se belief without a difference in belief content. I argue that various proposals for rejecting this determination thesis are unsuccessful. In the last part of the paper, I employ this determination thesis to argue for the existence of a type of belief content that is uniquely de se. (shrink)

I consider whether the self-ascription theory can succeed in providing a tenseless (B-theoretic) account of tensed belief and timely action. I evaluate an argument given by William Lane Craig for the conclusion that the self-ascription account of tensed belief entails a tensed theory (A-theory) of time. I claim that how one formulates the selfascription account of tensed belief depends upon whether one takes the subject of selfascription to be a momentary person-stage or an enduring person. I provide two different formulations (...) of the self-ascription account of tensed belief, one that is compatible with a perdurantist account of persons and the other that is compatible with an endurantist account of persons. I argue that a self-ascription account of tensed beliefs for enduring subjects most plausibly involves the self-ascription of relations rather than properties. I argue that whether one takes the subject of self-ascription to be a momentary personstage or an enduring person, the self-ascription theory provides a plausible B-theoretic account of how tensed belief and timely action are possible. When do objects at different times compose a further object? This is the question of diachronic composition. The universalist answers, ‘under any conditions whatsoever’. Others argue for restrictions on diachronic composition: composition occurs only when certain conditions are met. Recently, some philosophers have argued that restrictions on diachronic compositions are motivated by our best physical theories. In Persistence and Spacetime and elsewhere, Yuri Balashov argues that diachronic compositions are restricted in terms of causal connections between object stages. In a recent (...) article, Nikk Effingham argues that the standard objections to views that endorse restrictions on composition do not apply to a view that restricts composition according to compliance with the laws of nature. On the face of it, such restrictions on diachronic composition preserve our common-sense ontology while eliminating from it scientifically revisionary objects that travel faster than the speed of light. I argue that these attempts to restrict diachronic composition by appealing to either causal or nomological constraints face insurmountable difficulties within the context of special relativity. In this paper I examine an argument that has been made by Patrick Grim for the claim that de se knowledge is incompatible with the existence of an omniscient being. I claim that the success of the argument depends upon whether it is possible for someone else to know what I know in knowing (F), where (F) is a claim involving de se knowledge. I discuss one reply to this argument, proposed by Edward Wierenga, that appeals to first-person propositions and (...) argue that this response is unsuccessful. I then consider David Lewis’s theory of de se attitudes involving the self-ascription of properties. I claim that, according to this theory, there are two senses in which someone else can know what I know in knowing (F). I then argue that the second sense allows for the compatibility of de se knowledge with the existence of an omniscient being. (shrink)

The idea of phenotypic novelty appears throughout the evolutionary literature. Novelties have been defined so broadly as to make the term meaningless and so narrowly as to apply only to a limited number of spectacular structures. Here I examine some of the available definitions of phenotypic novelty and argue that the modern synthesis is ill equipped at explaining novelties. Philosophy has been a public endeavor since its origins in ancient Greece, India, and China. However, recent years have seen the development of a new type of public philosophy conducted by both academics and non- professionals. The new public philosophy manifests itself in a range of modalities, from the publication of magazines and books for the general public to a variety of initiatives that exploit the power and flexibility of social networks and new media. In this paper we examine the (...) phenomenon of public philosophy in its several facets, and investigate whether and in what sense it is itself a mix of philosophical practice and teaching. We conclude with a number of suggestions to academic colleagues on why and how to foster further growth of public philosophy for the benefit of society at large and of the discipline itself. Call ‘a substance’ a person who is at home in a relatively stable and unified sense-making framework: a social structure that to some degree specifies which categories are important for interpreting reality, which goals are worth pursing, which character traits are admirable, etc. Call ‘an accident’ a person who is not at home in one such framework. It is tempting to think that being a substance is preferable, but I present some considerations for thinking otherwise. Mexican philosophers Emilio Uranga and (...) Jorge Portilla, I argue, present notions of accidentality as decolonial tools. Uranga’s account enables Mexicans to have positive valuation of their being independently of the approving gaze of the colonizers and their standards of value. Portilla’s thought distinguishes between pernicious accidentality resulting from the disintegration of sense-making frameworks and authentic accidentality as a condition for freedom, self-creation, and ultimately for individual and communal liberation. What makes humans different from other animals, what humans are entitled to do to other species, whether time travel is possible, what limits should be placed on science and technology, the morality and practicality of genetic engineering—these are just some of the philosophical problems raised by Planet of the Apes. Planet of the Apes and Philosophy looks at all the deeper issues involved in the Planet of the Apes stories. It covers the entire franchise, from Pierre Boulle’s 1963 novel Monkey (...) Planet to the successful 2012 reboot Rise of the Planet of the Apes. The chapters reflect diverse points of view, philosophical, religious, and scientific. The ethical relations of humans with animals are explored in several chapters, with entertaining and incisive observations on animal intelligence, animal rights, and human-animal interaction. Genetic engineering is changing humans, animals, and plants, raising new questions about the morality of such interventions. The scientific recognition that humans and chimps share 99 percent of their genes makes a future in which non-human animals acquire greater importance a distinct possibility. Planet of the Apes is the most resonant of all scientific apocalypse myths. (shrink)

It is an unfortunate fact of academic life that there is a sharp divide between science and philosophy, with scientists often being openly dismissive of philosophy, and philosophers being equally contemptuous of the naivete ́ of scientists when it comes to the philosophical underpinnings of their own discipline. In this paper I explore the possibility of reducing the distance between the two sides by introducing science students to some interesting philosophical aspects of research in evolutionary biology, using biological theories of (...) the origin of religion as an example. I show that philosophy is both a discipline in its own right as well as one that has interesting implications for the understanding and practice of science. While the goal is certainly not to turn science students into philoso- phers, the idea is that both disciplines cannot but benefit from a mutual dialogue that starts as soon as possible, in the classroom. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

Leibniz claims that for every possible substance S there is an individual concept that includes predicates describing everything that will ever happen to S, if S existed. Many commentators have thought that this leads Leibniz to think that all properties are had essentially, and thus that it is not metaphysically possible for substances to be otherwise than the way their individual concept has them as being. I argue against this common way of reading Leibniz’s views on the metaphysics of modality. (...) I develop a model in which individual concepts are innocent; that is, individual concepts are divine ideas that permit God to know everything that will ever happen to all possible substances, if created, but these individual concepts neither require that all properties are had essentially nor require that it is metaphysically necessary for substances to be the way their individual concepts have them as being.
